As a condition of use of the pathway system the pass holder assumes all risk of personal injury, death or property loss resulting from any cause whatsoever including, but not limited to: the risks, dangers and hazards of collision or impact with natural or man-made objects or with other persons, negligence, breach of contract or breach of statutory duty of care on the part of Priddis Greens Golf & Country Club (the ‘Operator’), and it’s respective employees, instructors, guides, agents, volunteers, sponsors or assigned operator. The pass holder agrees that the Operator shall not be liable for any such personal injury, death or property loss and release the Operator and waives all claims with respect thereto. The pass holder agrees that any litigation involving the Operator shall be brought solely within the Province of Alberta and shall be within the exclusive jurisdiction of the course of this Province of Alberta. The pass holder further agrees that these conditions and any rights, duties, and obligations as between the Operator and the pass holder shall be governed by and interpreted solely in accordance with the laws of this Province of Alberta and no other jurisdiction.
